These Terms of Service ("Terms") govern your use of annphotography.site and describe the general terms under which Photography by Anette provides photography services. By using this website you agree to these Terms.

1. About Us

Photography by Anette is a photography business located at 2518 Burnsed Blvd, Ste 302, The Villages, FL 32163, serving The Villages and Central Florida.

2. Website Use

• Use this site for lawful purposes only.
• Do not attempt to disrupt, damage or gain unauthorized access to the site.
• Do not copy, download, reproduce or republish photographs or site content without written permission.
• Do not submit false information or use the contact form for unsolicited commercial messages.

3. Information Is Not An Offer

Prices, packages, session lengths and image counts shown on this website, including those on the homepage and pricing page, are general information and starting rates. They are not offers or guarantees. Final pricing is confirmed in your written quote and booking agreement.

4. Booking And Retainer

• A date is reserved only when a signed agreement and the required retainer are both received.
• Retainers are non refundable, because the reserved date is declined to other clients.
• The retainer applies toward your total balance.
• The remaining balance is due as stated in your agreement, generally before gallery delivery.
• Prices quoted are valid for the period stated in the quote.

5. Rescheduling And Cancellation

• Sessions may be rescheduled once with reasonable notice, subject to availability.
• Outdoor sessions affected by weather are rescheduled at no charge.
• Cancellation by the client forfeits the retainer.
• If illness, emergency or equipment failure prevents us from photographing your session, we will reschedule at the earliest mutual availability or, where that is not possible, refund all amounts paid. This is the limit of our liability in such circumstances.
• Late arrival shortens the session rather than extending the end time, unless the schedule allows otherwise.

6. The Session

• Clients are responsible for securing permission and paying any fees for private property, parks or venues requiring permits.
• An adult must accompany any minor being photographed.
• Clients are responsible for the conduct and safety of their group during the session.
• We reserve the right to end a session without refund in cases of abusive, unsafe or unlawful behavior.

7. Editing And Artistic Discretion

Image selection and editing style are at the photographer's artistic discretion. Delivered galleries include images chosen for technical and artistic quality. Unedited files, raw files and outtakes are not delivered or sold. Requests for edits beyond the included standard retouching are quoted separately.

8. Delivery

Typical turnaround is two weeks for portrait and family sessions, two to three weeks for events, and six to eight weeks for weddings. Turnaround times are estimates, not guarantees. Galleries remain online for the period stated in your agreement. Clients are responsible for downloading and backing up their images before the gallery expires.

9. Copyright And Usage

Copyright in all photographs remains with Photography by Anette. Clients receive a personal print release permitting personal use, printing and sharing. Commercial and advertising use requires a separate license. See the Copyright and Licensing page for full details.

10. Portfolio Use

Unless your agreement states otherwise, we may use selected images from your session in our portfolio, website, social media and marketing. You may opt out in writing at any time and we will discontinue future public use. Images of minors are used publicly only with written parental consent.

11. Prints And Products

Prints, albums and products ordered through your gallery are produced by professional labs. Color accuracy on prints ordered elsewhere using your print release cannot be guaranteed, since consumer labs vary widely. Custom product orders are non refundable once production begins.

12. Limitation Of Liability

To the maximum extent permitted by Florida law, our total liability for any claim arising from our services is limited to the amount you paid for the session in question. We are not liable for indirect, incidental or consequential damages. In the unlikely event of data loss, equipment failure or circumstances beyond our control, liability is limited to a refund of amounts paid.

13. Force Majeure

Neither party is liable for failure to perform due to events beyond reasonable control, including severe weather, hurricanes, illness, venue closure, power failure or government restrictions. In such cases we will reschedule where possible.

14. Governing Law

These Terms are governed by the laws of the State of Florida without regard to conflict of law principles. Disputes shall be brought in the state or federal courts located in Sumter County, Florida, unless your booking agreement provides otherwise.

15. Changes

We may revise these Terms at any time. Changes take effect when posted with an updated date. Your signed booking agreement controls where it conflicts with these Terms.
